By accessing or using Giftspan ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Description of Service

Giftspan is an AI-powered gift recommendation service. We help you find thoughtful gifts by:

  • Having conversations about your gift recipients
  • Building profiles based on interests and preferences
  • Generating personalized gift recommendations
  • Helping you organize wishlists and gift ideas

Account Terms

  • You must be at least 13 years old to use this Service
  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account
  • You are responsible for all activity that occurs under your account
  • One person may not maintain more than one account

Pricing and Payment

Free Tier

New users receive 3 free gift recommendations per recipient. This allows you to experience our service before committing.

Paid Service

Full conversations with unlimited recommendations are available for $40 per recipient. This is a one-time payment per recipient profile, not a subscription.

Refund Policy

If you're not satisfied with your recommendations, contact us within 7 days of purchase for a full refund. We want you to be happy with our service.

Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Harass, abuse, or harm another person
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to the Service
  • Use the Service for any commercial purpose without our consent
  • Collect or harvest any information from other users

User Content

You retain ownership of any content you provide to the Service, including recipient profiles and conversation content. By using the Service, you grant us a license to use this content solely for providing and improving the Service.

AI-Generated Content

Gift recommendations are generated by artificial intelligence. While we strive for quality recommendations:

  • Recommendations are suggestions, not guarantees
  • AI may occasionally produce inaccurate or inappropriate suggestions
  • You are responsible for evaluating and selecting gifts
  • We do not guarantee availability or pricing of recommended products
  • We are not affiliated with recommended retailers unless explicitly stated

Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Giftspan and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

Third-Party Links

Our recommendations may include links to third-party websites and products. We are not responsible for the content, policies, or practices of third-party sites. Purchasing from these sites is at your own risk.

Account Termination

By You

You may delete your account at any time from your account settings. Upon deletion, all your data will be permanently removed from our systems, including:

  • Your account and profile information
  • All recipient profiles
  • All conversation history
  • All wishlists and saved recommendations

By Us

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior. We will provide notice unless the violation requires immediate action.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS. AI RECOMMENDATIONS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIFTSPAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FROM GIFTS PURCHASED BASED ON OUR RECOMMENDATIONS.

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
